Please let me add that a bill of rights had been barely mentioned in the Philadelphia convention. One James Wilson (if memory serves) maintained that a bill of rights was superfluous because all power not expressly delegated to the new government was reserved to the people.
James Madison wrote to his mentor and close friend Thomas Jefferson, reporting to him of the goings-on (I believe Jefferson was in France, but I am not sure).
Thomas Jefferson wrote his friend back and said that a bill of rights was “what the people are entitled to against every government on earth.”
This clearly defines the purpose of every aspect of the bill of rights.
Madison used TJ’s words to help convince others.
